Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines the acceptable behavior of users of VirPhone's network, Voice over IP (VoIP) services, UCaaS platforms, and internet properties. We have established this policy to ensure the security, reliability, and privacy of our network and our customers.
1. Prohibited Activities
You may not use VirPhone's Services to engage in any of the following activities:
- Illegal Use: Utilizing the service to transmit any material that violates local, state, federal, or international laws.
- Harassment: Using the service to transmit material that is threatening, abusive, harassing, defamatory, or deceptive.
- Spam and Unsolicited Messaging: Transmitting bulk unsolicited email, SMS, or voice calls (robocalls) in violation of the CAN-SPAM Act or the TCPA.
- Network Abuse: Attempting to bypass system security, engaging in denial of service (DoS) attacks, or distributing malware/viruses.
- Fraud: Making fraudulent offers or utilizing stolen payment methods.
2. VoIP & Telephony-Specific Rules
TCPA Compliance
You are strictly responsible for complying with the Telephone Consumer Protection Act (TCPA) and the National Do Not Call Registry. You must have explicit consent before engaging in automated dialing or sending business SMS messages.
Caller ID Spoofing
You may not falsify your caller identification information (Caller ID spoofing) with the intent to defraud, cause harm, or wrongfully obtain anything of value, in compliance with the Truth in Caller ID Act.
Emergency Services & E911 Limitations
VirPhone provides Nomadic E911 services. You are required to register the physical location of each device or softphone with us. Failure to maintain an accurate location may result in emergency services being dispatched to the wrong address. You must not use auto-dialers to dial 911 or emergency numbers.
3. Bandwidth and Resource Usage
Our "unlimited" voice and SMS plans are subject to reasonable business use. Telemarketing, call center environments operating on standard business extensions, continuous continuous-call forwarding, or other practices resulting in disproportionately high usage are prohibited unless you are subscribed to a specific Contact Center or SIP Trunking plan explicitly rated for such traffic.
4. Monitoring and Enforcement
VirPhone reserves the right, but is not obligated, to monitor network traffic to ensure compliance with this AUP. If we determine that a violation has occurred, we may take immediate action, including but not limited to:
- Issuing a warning.
- Suspending your service temporarily.
- Terminating your account permanently without a refund.
- Reporting the activity to law enforcement or regulatory agencies.
5. Reporting Violations
If you believe you have been the victim of abuse originating from the VirPhone network, or wish to report a violation of this AUP, please contact us immediately at abuse@virphoneusa.com.
